Upon consideration of the court's order to show cause filed September 29, 2008; and the lack of any response thereto, it is
ORDERED that the order to show cause be discharged.
It is FURTHER ORDERED that Herbert A. Callihan, Jr. be disbarred and, accordingly, be prohibited from the practice of law before the United States Court of Appeals for the District of Columbia Circuit. See D.C. Cir. Rules, App. II, Rule V. Respondent's consent to disbarment by the Court of Appeals of Maryland while an investigation into allegations of misconduct was pending requires disbarment in this court. Id. It is
FURTHER ORDERED that Herbert A. Callihan, Jr. be prohibited from holding himself out to be an attorney at law licensed to practice before the United States Court of Appeals for the District of Columbia Circuit.
